On October 16, 2017, TCI requested the court to dismiss certain claims in our case, and to delay the scheduling of the case. The court issued an order in our favor denying TCI’s request and the case will go forward. The court confirmed that the plaintiffs may go forward with their claims of nuisance, trespass, negligence and failure to warn. The damages we seek include additional water expense, loss of use and enjoyment, annoyance and discomfort and any reduction in property value. Significantly, and believed to be a case of first impression in New Hampshire, the court agreed with us that we can assert a claim for medical monitoring to cover the cost of tests and examinations in order to catch any disease at the earliest time possible.
